Transparency Council approves procedure to guarantee the exercise of ARCO rights contemplated in Law No. 19.628 on Protection of Private Life

Introduction

On December 17, 2022, Resolution 489 exempt was published in the Official Gazette by which the Council for Transparency (“Council”) approves the procedure that aims to regulate the way in which, within the Council for Transparency, the reception, processing and resolution of requests or requirements to exercise the rights recognized to the holders of personal data in Law No. 19.628 on the Protection of Private Life shall be carried out.

The rights recognized in Law No. 19.628 on the Protection of Private Life are called ARCO rights, which consist of the rights of information, access, rectification, modification, elimination or cancellation, blocking and opposition.

The procedure regulates the entry of the request, verification of identity and background, admissibility and distribution, substantive review and notification.

This procedure will be effective from the date of its publication in the Official Gazette.
